Guernsey as an Alternative Jurisdiction

Guernsey has had a non-statutory trust law for at least a couple of hundred years. Trustees' powers are unlimited and are restricted or defined by the document creating or evidencing the Trust. In practice, this means that both, trusts and powers, will be as narrow or wide as the Settlor desires. And for the benefit of a settlor looking for a jurisdiction of tradition, the trust legislation of the United Kingdom may be extended to Guernsey by order of the Council.

Guernsey recognizes that settlors and trustees have the right or ability to select which system of law should be the proper law of a trust and in which place the administration of a trust should be carried on.

The taxation of trusts will be dependent upon the residence of the beneficiaries. There is no capital gains tax in Guernsey, nor tax, either on distribution of income or capital to non-resident beneficiaries; there are no local taxes on wealth and there are no stamp duties.

There are no prescribed formalities for establishing a Guernsey Trust. The trust may be established either by settlement or by declaration, and once established there is no mechanism for filing or recording in any public or other Register.
