Labor Law

In Panama, the basic juridical labor regulation is set by the Cabinet Decree Nº 252 of December, 30th 1971, whereby the Labor Code of the Republic of Panama was enacted. Likewise, Panamanian Labor Law consists of the Collective Bargaining Labor Agreements, the Agreements of the International Labor Organization, the Law 72 of 1975 (Construction Workers Law), and the Law Decree Nº 8 of February 26th, 1998 whereby the work of men at sea and at navigable waterways is regulated.

Even though the 1972 Labor Code did regulate a series of special contracts of different natures, Panama has also experienced the enactment of new labor rules applicable exclusively to certain workers’ sectors with the sole purpose of promoting foreign investments needed for the creation of new job opportunities, process that began with the enactment of Law 16 of November 6th, 1990, followed by Law Decree 1 of January 11th, 1996, and amended by Law Decree 2 of February 26th, 1996, which regulations apply to “Export Processing Zones”.

A Constitutional Amendment (Article 316 of the Constitution) also created a different labor system applicable to workers in the service of the Panama Canal, which is being in force since the year 2000.

It is our purpose to provide our clients with the elements that are necessary to solve the daily arising inconveniences in their labor relations, as well as an adequate management of those relations. Our group of specialized lawyers is well experienced in handling labor cases in the public and private sectors, and in the performance, with total honesty, of our professional practice in areas such as:

  • Work Permits.

  • Labor Contracts.

  • Termination of a labor relationship (dismissal, mutual consent, resignation).

  • Handling of labor cases before the Reconciliation and Decision Board (dismissals of a disciplinary nature, or of not imputable nature, as well as others).

  • Handling of labor cases before the common courts of justice (Sectorial Labor Courts, Higher Labor Courts, Supreme Court of Justice).

  • Proceedings before the administrative courts of justice (Ministry of Labor and Work Development).

  • Collective Bargaining (Collective Labor Agreements).

  • Application and Scope of the labor legislation in general.

  • Administrative and judicial proceedings before the labor authorities.

  • Administrative and judicial advice about the work of men at sea and at navigable waterways, as well as others.
